Transfer of Education in State list

News:

Tamil Nadu Chief Minister M.K. Stalin called for transferring education back to the State List of the Seventh Schedule of the Constitution.

He said that only this would help to abolish the centralised examinations like NEET.

Education, originally a state subject, was moved to the Concurrent List by the Indira Gandhi government during the Emergency.

About:

In the Indian Constitution, there are three lists that outline the distribution of powers between the central government and the state governments: the Union List, the State List, and the Concurrent List.

Union List: This list contains subjects on which only the central government can make laws. These subjects include defense, foreign affairs, currency, atomic energy, etc.

State List: This list contains subjects on which only the state governments can make laws. These subjects include police, public health, agriculture, local government, etc.

Concurrent List: This list contains subjects on which both the central government and the state governments can make laws. These subjects include education, criminal law, marriage and divorce, bankruptcy and insolvency, etc.

Education

In the context of education, the "Education" entry in the Concurrent List allows both the central government and the state governments to legislate on matters related to education.

This means that while the central government can create overarching policies and guidelines for education across the country, individual states also have the power to enact laws specific to education within their jurisdiction.

This concurrent jurisdiction often leads to a shared responsibility in the realm of education.

Both the central government and the state governments can work together to improve the quality of education, establish educational institutions, and promote educational standards.

However, it can also lead to challenges and complexities if there are differences in policies and priorities between the central government and the states.
